Attorney Joe Murphy and I were in the middle of a trial against the owner of a large chain of grocery stores. Our client was injured when she slipped and fell in water. Liability and damages were hotly contested by the attorneys representing the grocery store. We rested our case and it was time for the Defendant to present its defense. The Defendant’s star medical expert took the stand and, predictably, gave testimony that seemed very damaging to our client. But then we crossed examined the expert. Through a very vigorous and thorough cross-examination, we were able to show the jury that the expert was really just a “hired gun” who had little facts to support his opinions. The Defendant agreed to settle the case immediately after the cross-examination for $140,000, an amount far exceeding the pre-suit offer.
