Florida has strict deadlines which govern construction liens, commonly known as mechanic's liens. If you intend to file a mechanic's lien to help ensure you receive payment, you have only ninety (90) days from substantial completion of the work to file your mechanic's lien. You cannot rely on punch work to extend this deadline. You have forty-five (45) days from the day you first start the work or deliver materials to the job to file your Notice to Owner if you are not in direct contact with the owner. The mechanic's lien is valid for one (1) year from the date of recording. If a lawsuit is not filed to foreclose the Claim of Lien within the one (1) year, the mechanic's lien is void.
